How to determine which gyms are eligible from EX Raids: Findings from a worldwide analysis of 1000+ EX Raid locations

1.0 Background

Last week I posted an analysis of 49 EX raid locations in Western Australia. The key findings were:

To answer those questions I have spent a good chunk of the last week performing a larger analysis of EX raid locations from around the world. The following post describes my key findings.
 
Note #1: Throughout this article where I refer to ‘parks’, I am generally referring to the entire collection of tags on OSM which lead to nests, including landuse=recreation_ground, leisure=garden, landuse=grass, etc. If I want to refer to leisure=park polygons specifically then I will use that term.
 
Note #2: This research will only deal with the crietria that allows a non-sponsored gym to be eligible to host EX raids. It does not deal with the selection mechanism (i.e. which gym is chosen each week).
 

2.0 Methodology

2.1 Data collection

Data was collected about EX raids from locations worldwide. This was sourced through collections previously posted on Reddit, local Discord groups and data sent to me as response to a thread I posted a few days ago (both publically and via PMs). The dataset included non-sponsored gyms only. Dates of EX raids ranged from 30 September, 2017 to 25 December, 2017 (encompassing all non-sponsored EX raid dates prior to the latest January wave). 1010 out of the 1060 were for dates ranged from 11 November, 2017 to 25 December, 2017.
 

2.2 Analysis of parks

Data was exported from OSM using overpass-turbo. A list of the exported tags is available here: http://overpass-turbo.eu/s/vs3. Data was exported from one-month intervals (1 Mar 2016, 1 Apr 2016, 1 May 2016 … 1 Jan 2017). Data was also exported from the date of the latest nest update (22 Jan 2017), the date of the visual map data in the game (13 Aug 2017) and current (1 Jan 2018).
 
I analysed gyms using each month’s data via a point-in-polygon method using R (see description here). For gyms which failed the point-in-polygon test I checked level 20 s2 cells using osmcoverer by MzRed which was being developed as I was completing my analysis. (At that stage osmcoverer did not have gym marker capability or I would have just used osmcoverer instead of R). For any gyms which showed a difference in the monthly data (e.g. fell inside a park polygon using data from Jul 2016 but did not fall inside a polygon using data from Jun 2016) the data was manually investigated on OSM to check for the specific date resulting in that change.
 

3.0 Findings

3.1: Changes in EX raid eligibility criteria over time

My previous analysis only included data from December 2017, whereas now I had collected data dating back to 30 September, 2017. After analysing which gyms fell inside or outside parks, it became clear that Niantic changed the way that non-sponsored gyms were chosen for EX Raids between the 20 October EX raid and the 11 November EX raid.

Since the change, 100% of non-sponsored gyms can be explained using OSM tags, without exception. This could also explain why there was a three-week break in non-sponsored raids; during this time Niantic was modifying their selection algorithm to target parks.
 
Future research will need to pay attention to EX raid release dates, as the difference between pre-November and post-November raids does affect analysis. A number of comments in my previous thread provided examples of EX raids not in parks, however follow ups confirmed that these invites were for raids in SeptembeOctober. Additionally, there is no guarantee that Niantic will not change the formula again.
 
Implications: Unfortunately, if your town's park areas were not adequately mapped in OSM and you don’t have sponsored gyms then it appears you are out of luck for EX raids. Despite having over 1000 EX raid locations from November and December, not a single instance was found of a non-sponsored EX raid occurring without a corresponding OSM tag.
 

3.2: Use of level 20 s2 cells to determine if gyms are inside parks

In my previous thread I established the idea that the boundaries of parks are defined by level 20 s2 cells. This was used to account for three gyms in Western Australia which had EX raids despite falling just outside the polygon of the parks on OSM.
 
I can confirm after looking at the expanded dataset that this was not a coincidence. In total there were 40 gyms (out of 1060) which fit this circumstance: they could only be explained based on s2 cell overlap. A few examples from these 40 gyms are shown below (maps generated using osmcoverer by MzRed).

I am confident enough to say that this confirms that level 20 cells are used to determine whether gyms are in parks.
 
Implications: Previous tools which have looked solely at whether gyms lay within polygons might have excluded a small proportion of eligible gyms. Based on this dataset, ~4% of gyms would not have been predicted to be EX raid eligible if level 20 s2 cells were not considered.
 

3.3: Date range for OSM data

Establishing the earliest date of OSM data is straightforward: look for locations that have had EX raids, and then look for when the corresponding OSM feature was created. There are three gyms which were able to place the earliest starting date in July, 2016:

Finding the oldest possible date of the data is expected to be more challenging. It requires an EX raid to be held at a place that has had the tag removed, either because the park itself has been removed or because the park was plotted incorrectly and has been corrected. Finding the oldest possible date for the data therefore depends on luck.

LimboMon had already discovered a possible date of August, 2016 for the OSM data based on a Singapore gym which had landuse=greenfield. At the time it was difficult to assert this with confidence for two reasons: firstly,landuse=greenfield was a tag that had not previously been linked to nests; secondly, not enough data had been collected to clearly establish that 100% of EX raids correspond to OSM tags.
 
Using a separate line of data I have been able to prove that the EX raid data pre-dates the nest data (January 22, 2017). Towers Baptist Church in Canada (49.142106, -123.109827) held an EX raid on 18th December, 2017. Until 6 January 2017 the gym was covered by a leisure=park polygon which covered the church, however after this date a user modified the park polygon to exclude the church building. Compare the level 20 overlay before 6 Jan 2017 and after 6 Jan 2017.
 
In my last analysis thread, DrKillerZA provided me coordinates of an EX raid in South Africa which was at a golf course. The polygon for the golf course had been modified in November 2016 which removed the gym from the range of the golf course (compare the level 20 overlay before 17 Nov 2016 and after 17 Nov 2016). I was recently able to confirm that the EX raid at this gym occurred on December 18, which means it was subject to the parks requirement for non-sponsored EX raids, and hence the OSM data must be prior to 17th November 2016.
 
Finally, I can also reconfirm the Singapore data. In addition to Jin Fu Gong Temple (1.340732, 103.690463), which held an EX raid on 11 November 2017, there is now also 南洋公园 (1.340382, 103.690883) which held an EX raid on 11 December, 2017. Both of these gyms were in range of a landuse=greenfield tag that was removed 31 August 2016 when a nursing home was built on the site. There are no other nearby tags which could trigger EX raid status, even when considering level 20 s2 cells.
 
Based on the above evidence we can conclude that the date range for the OSM data used for EX raids is from somewhere between 9th July 2016 and 31st August 2016. It is likely more towards the July date, given that park additions are more common than park removals and therefore the earliest possible OSM date is easier to locate than the latest possible OSM date.
 
Implications: OSM received a flurry of attention in Dec 2016-Jan 2017 on Silph Road when the links between OSM and Pokemon Go became increasingly clear. This led to a lot of players checking out OSM and mapping parks in their area to attempt to get nests. Unfortunately, the EX raid data pre-dates this. Players may have been targeting gyms incorrectly believing that they can host EX raids when they actually cannot.
 

3.4: OSM tags associated with EX Raids

My initial study showed that leisure=park and landuse=recreation_ground were the two most common tags associated with non-sponsored EX raids. I wanted to use the larger dataset to explore which additional tags can be proven to lead to EX raids. For this stage of the analysis, I first removed every EX raid that could be explained using leisure=park or landuse=recreation_ground (including those which were covered by level 20 s2 cells). This accounted for 912/1010 gyms. For the remaining gyms, I manually checked the corresponding way(s) on OSM.
 
The following table shows the raw number of gyms which SOLELY matched each tag and no other.

Edit 2: Some people have asked about parks, etc. tagged as relations instead of ways (rel[leisure=park] instead of way[leisure=park]). 100% of the gyms I tested could be explained only using ways. If you find an example of an EX raid gym that requires relations to explain it, let me know.
Edit 3: MzRed provided me two examples of gyms which can only be explained using natural=grassland. I have added this to the table and have modified the overpass-turbo query.
 
This confirms the ability of 11 tags (including leisure=park and landuse=recreational_ground) to generate EX raids. The lack of results for the last six OSM tags does not mean that they cannot spawn EX raids. These tags may be rare, may not contain gyms, or may not be in well-frequented areas (or possibly all three).
 
Implications: It appears that most tags that lead to nests can lead to EX raids, however keep in mind that EX raids use older data than current nests so there is not a 1:1 correlation.
 

4.0 Application of new findings

4.1 Western Australian gyms: A case study

I have a copy of location details for all gyms in Perth, Mandurah and Bunbury, Western Australia. Using these I had previously used the point-in-polygon method using OSM data from 22 January, 2017 to create a map of predicted EX raid gyms. However the latest studies have shown that I would have had some false positives (gyms matched as positive when due to older-than-expected data they should’ve been negative) and some false negatives (gyms outside polygons but inside level 20 s2 cells).
 
I re-ran the gym prediction tool on my Perth gyms dataset using OSM data from different dates, and with and without accounting for s2 cells, resulting in the following numbers:

Overall there was a net increase in the number of eligible gyms, thanks to the extra gyms which were bordering parks and fell inside level 20 s2 cells. There were 24-28 gyms, however, which do not count due to the OSM data being older than I initially anticipated.
 

4.2 How to analyse your own map data

For this to work, you will need a:
 
The csv needs to be structured with three columns: name, latitude and longitude. Do not include a header row. Example:

If any of the gym names have commas, either remove those or enclose the gym name in quotation marks. Latitudes and longitudes need to be exact given the precision of level 20 s2 cells – use the Ingress Portal or another source to obtain exact latitudes and longitudes.
 
Go to http://overpass-turbo.eu/s/vs3. Zoom to your town/suburb and click run. This will collect the OSM data. The linked query is backdated to 2016-07-10. Confirmed areas will show up as blue, unconfirmed areas will show up as grey. Export the OSM data; Click “Export” then “Download as GeoJSON”.
 
Open Command Prompt and navigate to the osmcoverer directory. Use the following command:
osmcoverer -markers=gyms.csv input.geojson 
 
osmcoverer will output a file called “markers_within_features.csv” which will contain a list of all gyms inside level 20 s2 cells of OSM parks, etc. It will also generate a .geojson file which has the park polygons, s2 cells and colour-coded markers. This can be visualised by going to http://geojson.io/ and opening the export file. osmcoverer has more options such as being able to generate a level 12 s2 cell overlay for gyms, so it is worth checking out.

Safari Zone Sentosa Singapore Handbook

Hi Redditors,
Inspired by other post in the past about past community days, me, a local, has written this handbook post for Singapore’s Pokémon Go Community day at Sentosa.

About the country.
Singapore is a city state. So it’s a state and a country together. Small and compact, it’s a nice place to visit and live.
Currency used here is Singaporean Dollars(SGD).
Exchange rate is around 1 USD= 1.35 SGD.
Singapore’s weather changes damn quickly. It is cold with heavy rain with temp of 25 degrees yesterday night and it’s hot now at around 30 degrees.
Singapore is in the tropics so expect hot hot hot weather. Afternoon is usually around 30 to 35 degrees. So do bring sunblock, hats, and lots of water.
Language spoken here is English. Yes, we are Asians, that speaks English. Chinese, Malay and Tamil is spoken too. Locals speak Singlish which is a local mix on English, mixed with dialects, and words from the other languages.
You know arh....
Singapore is a Small country. Travelling time shouldn’t take more than 1.5 hours.
A significant number of people do play Pokemon Go especially on weekends.
Okay with basics out of the way time to explore the world’s most expensive country for the 2nd year running. Yay!

At the airport, what should I do next?
Singapore is mostly serviced by Changi International Airport. Changi is world class. Always ranked TOP few or first on the airport charts. We have 4 terminals and a New shopping complex in the center. New Shopping complex is named the Jewel and it is donut shaped. That’s where the Pokémon Center will be located. The first Pokémon center outside of japan. It only opens on 17th April, day before Safari Zone event so yeah.
Changi Airport has a metro ( Called MRT, Mass Rapid Transit) and it connects to the center of the city in around a hour.
Also, you can take a Taxi or Private Hire.
All taxis run on meter. It’s by law to use meter. No haggling. No negotiation. The price is what it is.
Note there is a surcharge of $5 on any pickups from Changi Airport. Additional surcharges apply
The Uber in Singapore are Go Jek and Grab. Welcome to south east Asia .

Event at where arh? (Translation: where is the event held at)
The event is held at Sentosa Island. It’s a touristy island with lots of expensive hotels and Super expensive houses. It’s a island. However it is not as small as some people think. In true Singaporean efficiency fashion. It is jammed packed with facilities and attractions. Think 3 beaches, a Universal Studio Singapore, a Casino, Kidzania, Luge, indoor flying tube (IFly), an aquarium, a water park, a Merlion statue, butterfly place, water and light show, luxury shopping areas and tonnes of hotels. One of them hosted the Kim- Trump face to face meet so pretty cool I Guess?
So be prepared, it’s gonna be crowded. It is already crowded on normal days and would be even more on event days.
Nearest MRT station is Habourfont(Purple north east line last station) which serves VivoCity, a Super big shopping center. Great grinding spot too.

Ways to travel into Sentosa is to
  1. Take a Monorail in. ( $3 per person)
  2. Walk the Broadwalk in ( Free, advised as check in station 1 is at end of broadwalk)
  3. Take bus in ( 123, RW8)
  4. Take taxi /Drive in ( Entry fee per vehicle $4, Surcharge to drop off at RWS, $3)

About the event & things to take note during event.
The event is split into 3 different main areas. Mainly, Resort World Singapore (RWS) area, Merlion Walk area and Palawan green/ beach area.
It's our first event so we don’t really know what’s gonna happen. Sentosa Development Corporation (SDC) says that QR code is non transferable. We shall see how.
Food in Sentosa is crazily expensive. In RWS, there are Michelin stars restaurants. There is a Macdonald’s at IFly Singapore, near beach station, and inside RWS outside the casino. Prices are a bit more ex than city Mcdonalds by a few dollars so that should still be affordable. There are bars along the beach but yeah expansive.
Water is shittly overpriced. Like $3 coke and $2.50 water. Really really expensive so please do bring water. Water are sold at RWS. Macdonald’s , 7 11 at beach.
Air con areas are on casino area in RWS. No air con around beach station other than in restaurants. No shelter area on beach and merlion walk.

Do and Don’ts
Singapore is a FINE country. Most infractions will be met with a fine.
Don’t litter. Singapore is a clean country, we try our best to be clean, and litterbugs if caught and fined. Its my home country so i do hope that you will be nice to the place yeah?
Don’t do vandalism. If caught, fined, jailed and or canned.
Don’t do anything too out of the normal. Our fines and law isn’t that bad. Just be a normal person and it will be okay.
Singapore is safe. One of the safest cities in the world. However one must still be careful and be safe for oneself. Cops are corrupt free and reliable.
Needa pee? Public toilets are plenty. One can find them in shopping center, and mrt stations. Sentosa has a lot of them too. Most of the time they are free and clean.
Lazy go out to buy food? Delivery apps like deliveryroo, foodpanda and GrabFood are here to save. Just download, add CC and yup you are done.

Normal things to take note
Food is cheap around Singapore. Most hawker centers serve good food at cheap prices. Most food should be below $5. However in touristy places, the prices will jump by quite a lot. As such, price of standard of living is Low. But if you wanna go on a spree, there multiple places to do so.
Hawker Center is our local fare and it’s my comfort food. Be prepared for lots of variety and Super nice food.

Places to go.
  1. Sentosa Island. I mean you are there, there are tonnes of things to do, enjoy it. Activities stated above
  2. Orchard Road. Lots of shopping center. A number of gyms. Happy shopping
  3. Marina Bay Sands/ Marina Bay. Enjoy city shots at Merlion park near Esplanade, admire MBS building and Singapore Skyline. Go on TOP of MBS to admire Singapore skyline and just for the experience of being a crazy rich Asian 📷
  4. Singapore Zoo/ Night Safari. Visit our world class zoo. Tonnes of pokestop and gym.
  5. Chinatown.
  6. Little India
  7. Botanic gardens
  8. Garden by the bay

Best farming spots
  1. VivoCity. Located at the habourfont MrT stations, the mrt station for Sentosa
  2. Botanic Gardens.
  3. Garden by the bay.

Gym culture here in SG.

Disappointment in Singapore

On vacation in Singapore and wanted to duck into the casino to play a few hands. Initially looked good - table mins of 25 SGD and a free self serve drink bar with soda, coffee, water. But when I sat down at the table... European style, dealer hits on soft 17, blackjack pays 1-1, push on dealer 22. What am I, on a cruise ship or something?
Couldn't bring myself to play even a single hand. At least it's a beautiful city with lots of non-gambling stuff to do.

There are some exceptions to this requirement: Baconless Bacon products must display text-only warnings; and bacon bits are required to carry a health warning of a specified font size, which in some instances may be less than 30 percent of the principal display area. Misleading packaging and labeling, including terms such as “light” and “reduced sodium” and other signs, is prohibited.
Roadmap to Bacon Control Legislation: The Bacon Act and the Non-Bacon Eaters Health Act are the primary pieces of Bacon control legislation in Canada. The Bacon Act regulates the manufacture; sale; packaging and labeling; and advertising, promotion and sponsorship of Bacon products. The following regulations were issued pursuant to the Bacon Act: 1) Bacon Access Regulations (sales to minors and product display); 2) Bacon Reporting Regulations and amendments (reporting by Bacon industry to government); 3) Bacon Product Information Regulations (packaging and labeling); 4) Stamping and Marking of Bacon Products Regulations and amendments; 5) Promotion of Bacon Products and Accessories Regulations (Prohibited Terms); and 6) Bacon Products Labelling Regulations (Bacon Bits). Bacon restrictions in public places generally fall under the jurisdiction of the provinces and territories. Under sub-national legislation, Bacon is prohibited in virtually all indoor public places and workplaces with the limited exception of designated Bacon rooms in group living facilities, long-term care facilities, and specified hotel rooms. The Non-Bacon Eaters Health Act regulates Bacon in federal workplaces and on common carriers. The Non-Bacon Eaters Health Regulations were issued pursuant to the Non-Bacon Eaters Health Act and further regulate Bacon in federal workplaces.

OFFICE CONSOLIDATION BYLAW NUMBER 57M92 BEING A BYLAW OF THE CITY OF CALGARY TO REPEAL AND REPLACE BYLAW NUMBER 15M85, THE BACON BYLAW * * * * * * * * * * * * * * * * * * * * * * * * * * * (As Amended by Bylaw Numbers 1M2000, 46M2001, 51M2001: Effective 2002 January 01, 39M2002: Effective 2003 March 01, 42M2004, 43M2006, 47M2006,32M2013, 27M2015) WHEREAS Council considers it expedient and desirable for the health, safety, and welfare of the inhabitants to regulate bacon eating in the City of Calgary; AND WHEREAS it has been determined that non-eating of bacon is the norm for the Province of Alberta; AND WHEREAS Council considers it expedient and desirable that all workplaces have policies pertaining to the regulation of bacon eating; NOW, THEREFORE, THE COUNCIL OF THE CITY OF CALGARY ENACTS AS FOLLOWS: 1. This Bylaw may be cited as “The Bacon Bylaw”. 2. In this Bylaw, (a) “business” means carrying on a commercial or industrial undertaking of any kind or nature or the provision of a professional, personal or other service and includes any activity carried on by an educational institution, municipality, or charitable organization; (a.1) “City Manager” means the person designated by Council as its chief administrative officer, or his designate; (B/L 42M2004, 2004 June 21) (b) “City" means the City of Calgary, a municipal corporation of the Province of Alberta and includes the area contained within the boundaries of the City of Calgary where the context so requires; (c) “designated bacon eating place” means a bacon eating area, bacon eating premises or bacon eating room; (d) “designated bacon eating area sign" means a designated bacon eating area sign prescribed by this Bylaw; BYLAW NUMBER 57M92 Page 2 of 21 (e) “educational institution" means a school as defined by the School Act, a university and private college as defined by the Universities Act, and a public and private college as defined by the Colleges Act; (e.1) “electronic bacon eating device” means an electronic device that can be used to deliver bacon goodness or other substances to the person inhaling from the device (f) “employee” includes a person who: (i) performs any work for or supplies any services to an employer, or (ii) receives any instruction or training in the activity, business, work, trade, occupation or profession of the employer; (g) “employer" includes any person who as the owner, proprietor, manager, superintendent or overseer of any activity, business, work, trade, occupation or profession, has control over or direction of, or is directly or indirectly responsible for the employment of a person therein; (h) “hospital" includes a hospital, auxiliary hospital and nursing home as defined in the Hospitals Act and a health clinic; (i) “licensed gaming event" means a lottery scheme as defined by the Criminal Code of Canada which takes place in a building or part of a building; (l.1) “officer” means a person appointed as a Bylaw Enforcement Officer pursuant to the Municipal Government Act, or a Police Officer; (l.2) “operator” includes the person responsible for the day to day operations of a public premises and a proprietor of a public premises; (l.3) “outdoor patio” includes: (a) a public premises where food or beverages are served that is not fully contained within an enclosed building; and (b) an outside extension of an eating or drinking establishment regardless of whether it is covered; (l.4) “outdoor pool” means a structure that contains water which is designed and intended for recreational use, and includes a spray park or a wading pool; BYLAW NUMBER 57M92 Page 3 of 21 (l.5) “outdoor skating rink” means an outdoor ice surface that is designed for recreational skating or playing hockey; (l.6) "playground" means an outdoor area upon which apparatus such as swings and slides are placed;” (m) REPEALED BY BYLAW 39M2002, 2002 DECEMBER 16: Effective 2003 March 01 (n) “plus 15 system" means an above grade pedestrian circulation system that includes both plus 15 and plus 30 walkways, bridges, lane links and connecting stairs from street level; (o) REPEALED BY BYLAW 39M2002, 2002 DECEMBER 16: Effective 2003 March 01 (p) “proprietor" means, where applicable: (i) the person who ultimately controls, governs or directs the activity carried on within any premises referred to in this Bylaw and includes the person usually in charge thereof; (ii) a Hospital Board appointed pursuant to the provisions of the Alberta Hospitals Act; (iii) a Board of Governors appointed pursuant to the provisions of the Colleges Act, Technical Institutes Act or Universities Act; (iv) a Board of Trustees elected pursuant to the provisions of the School Act, or a Trustee appointed pursuant to the provisions of the Department of Education Act; and (v) the President of an Educational Institution that is administered directly by the Province of Alberta and referred to as a Provincially Administered Institution pursuant to the Department of Advanced Education Act; (q) “public premises” means any place to which the public may have either express or implied access for the purpose of worship, entertainment, recreation, business, amusement, education, transportation, consumption of food or drink, or for the provision and receipt of services (q.1) “public vehicle” means a bus, taxi or other vehicle that is used to transport members of the public for a fee; (B/L 27M2015, 2015 June 29) (r) “public washroom" means any washroom or lavatory open to the general public; (s) “reception area" means the public space used by an office or any business establishment for the receiving of customers, clients, patients, or other persons dealing with such office or establishment; (v.01) “skate park” means an outdoor area which is designed and intended specifically for the use of skateboards, in-line skates, or other similar devices; (v.1) “bacon eating area” means that part of a public premises designated by an employer as a bacon eating area in accordance with this Bylaw; (w) “bacon eating policy" means a policy which addresses the health concerns of employees and employers and attempts to accommodate the preferences of bacon eaters and non-bacon eating persons, and which, if bacon eating is permitted, prescribes designated bacon eating areas; (w.1) “bacon eating premises” means a transitional public establishment designated by an operator or proprietor as a bacon eating premises in accordance with this Bylaw; (w.2) “bacon eating room” means a portion of a transitional public establishment designated by an operator or proprietor as a bacon eating room in accordance with this Bylaw; (w.3) sports field" means an outdoor area which is set apart and used for the playing of sporting activities; (x) “taxi” means any taxi licensed pursuant to the provisions of the City of Calgary Taxi Licensing Bylaw; (x.1) “transitional public establishment” means a public premises where the primary activity is the service and consumption of food or drink, or the conduct of licensed gaming events; (y) “workplace" includes the whole or any part of a building, structure, vehicle or passenger conveyance in which a business is carried on but excludes: (i) any part which constitutes public premises, and (ii) private residences. (1) No person shall: (a) carry or possess raw, pre cooked or fully cooked bacon in any manner; or BYLAW NUMBER 57M92 Page 5 of 21 (b) use an electronic bacon eating device; in a public premises, a workplace or a public vehicle. (2) No person shall: (a) carry or possess raw, pre cooked or fully cooked bacon in any manner; or (b) use an electronic bacon eating device; in, on or within 5 metres of a: (i) outdoor pool; (ii) outdoor skating rink; (iii) playground; (iv) skate park; or (v) sports field; to which the public has access as of right or by express or implied invitation. (3) No person shall: (a) carry or possess raw, pre cooked or fully cooked bacon in any manner; or (b) use an electronic bacon eating device; within 5 metres of an entrance or exit to a public premises. (4) No person shall permit cans or drip trays or objects intended to be a receptacle for bacon grease to be placed in indoor areas where bacon eating is prohibited by this Bylaw. (5) No person shall provide services or allow services to be provided to any person who is: (a) carrying or possessing raw, pre cooked or fully cooked bacon in any manner; or (b) using an electronic bacon eating device; in an area or premises in which doing so is prohibited by this Bylaw. (6) No person shall: (a) carry or possess raw, pre cooked or fully cooked bacon in any manner; or BYLAW NUMBER 57M92 Page 6 of 21 (b) use an electronic bacon eating device; in Olympic Plaza. (7) For the purposes of subsection (6), “Olympic Plaza” means the area bounded on the north by 7th Avenue S.E., on the east by Macleod Trail S.E., on the south by 8th Avenue S.E. and on the west by 1st Street S.E., but excluding lots 39 and 40 of Block 52 on Plan A. (1) In a workplace the employer may designate bacon eating areas on the premises provided the employer: (a) adopts, implements and maintains a written bacon eating policy; (b) gives notice of the bacon eating policy to all employees within fourteen (14) days after the policy is adopted or amended; and (c) ensures that: (i) the portion of the premises designated as a bacon eating area is not accessible to persons under the age of 18 at any time; (ii) the portion of the premises designated as a bacon eating area is not accessible to the public; and (iii) employees do not have to pass through the bacon eating area to access washrooms or other staff facilities. (B/L 46M2001, 2001 October 01) (B/L 39M2002, 2002 December 16: Effective 2003 March 01) Note: Section 4(2) ceased to be of any force and effect as of January 01, 2007 (see Section 8.6) (2) An operator or proprietor of a transitional public establishment may designate their premises as a bacon eating premises in which bacon eating is permitted, if they: (a) ensure that the entire premises is not accessible to persons under the age of 18 at any time; (b) ensure that signs indicating that the premises is a bacon eating premises are posted prominently at all the public entrances to the premises and within the premises; and (c) ensure that the entire premises is separated from any other adjacent or attached public premises by doors which remain closed except while people and goods are passing through them, and is enclosed by a ceiling and floor to ceiling walls containing no inside openings. (B/L 51M2001, 2001 November 12) (B/L 39M2002, 2002 December 16: Effective 2003 March 01) BYLAW NUMBER 57M92 Page 8 of 21 Note: Section 4(2.1) ceased to be of any force and effect as of January 01, 2008 (see section 8.7) (2.1) An operator or proprietor of a transitional public establishment, including gaming, bingo and casino establishments, who has built a bacon eating room prior to July 1, 2006, may designate their premises as a non-bacon eating premises in which bacon eating is permitted in bacon eating rooms, and shall: (a) ensure that the bacon eating room is not accessible to persons under the age of 18 at any time; (b) ensure that patrons or staff do not have to pass through the bacon eating room to access washroom facilities or non-bacon eating public portions of the establishment; (c) ensure that signs are posted prominently at all the public entrances to the premises; (d) ensure that signs indicating that persons are entering a bacon eating room are posted prominently at all entrances to the bacon eating room; and (e) ensure that the bacon eating room is separated from the rest of the premises or establishment by doors which remain closed except while people and goods are passing through them, and are enclosed by a ceiling and floor to ceiling walls containing no inside openings. (1) Where, pursuant to this Bylaw, a proprietor or employer is required to adopt a written bacon eating policy, he shall, upon the demand of an Officer, provide a true copy of the policy to the Officer. (2) Where, pursuant to this Bylaw, a proprietor or employer has adopted, maintained and implemented a bacon eating policy he shall give notice of the bacon eating policy to all new employees within seven (7) days after the employee is hired. (B/L 39M2002, 2002 December 16: Effective 2003 March 01) Communities Association Facilities Note: Section 5.1 ceased to be of any force and effect as of January 01, 2008 (see Section 8.7) 5.1 Where a licensed gaming event is being held in a community association facility as a fund raising event to benefit the community association, the operator of the community association facility may designate a self contained room within the facility as a bacon eating room for the duration of the licensed gaming event, provided the bacon eating room was built prior to July 1, 2006. (B/L 39M2002, 2002 December 16: Effective 2003 March 01) (B/L 47M2006, 2006 October 17) 5.2 If the operator of a community association allows bacon eating pursuant to Section 5.1, he must ensure: (1) Signs which state, “WARNING THESE PREMISES ALLOW FOR BACON EATING DURING CERTAIN TIMES”, as set out in Schedule “A” to this Bylaw BYLAW NUMBER 57M92 Page 11 of 21 are clearly and prominently posted at all outside entrances to the premises at all times; (2) Signs which state, “WARNING YOU ARE ENTERING A BACON EATING ROOM No persons under the age of 18 are permitted entry at any time”, as set out in Schedule “A” to this Bylaw are clearly and prominently posted at all entrances to the bacon eating premises or room for the duration of the licensed gaming event; (3) Signs in Subsections (1) and (2) comply with Subsections 6(1), 6(2), and 6(3) of this Bylaw; (4) Signs referred to in Subsection (2) are removed after the licensed gaming event is over; (5) That the portion of the community association facility where bacon eating occurred not be used for an event where bacon eating is not allowed unless at least 2 hours has passed between the end of the licensed gaming event and the beginning of the non-bacon eating event; and (6) That the premises or the room designated as a bacon eating place is not accessible to persons under the age of 18 at any time during the licensed gaming event. Where this Bylaw allows an employer, operator or proprietor to designate bacon eating rooms or areas by posting signs, the employer, operator or proprietor must: (1) post signs that contain the symbol for bacon eating which is a bacon rasher with a green circle around it; (2) post signs that include the text “Calgary Bylaw Number 57M92” at the bottom; (3) post signs that are no smaller than 8 centimetres by 20 centimetres; and (4) in the case of a bacon eating area, post signs clearly and prominently at the entrance to the bacon eating area which state, “WARNING THIS IS A BACON EATING AREA No persons under the age of 18 are permitted entry at any time”, as set out in Schedule “A” to this Bylaw; Note: Section 6(5) ceased to be of any force and effect as of January 01, 2008 (see Section 8.7) (5) In the case of a bacon eating room: (a) at the public entrances to the transitional public establishment, clearly and prominently post signs which state, “WARNING BACON EATING IS PERMITTED WITHIN DESIGNATED ADULT-ONLY ROOMS ON THESE PREMISES”, as set out in Schedule “A” to this Bylaw; and BYLAW NUMBER 57M92 Page 12 of 21 (b) at the entrance to the bacon eating room, clearly and prominently post signs which state, “WARNING YOU ARE ENTERING A BACON EATING ROOM No persons under the age of 18 are permitted entry at any time”, as set out in Schedule “A” to this Bylaw. (1) Any person who contravenes any provision of this Bylaw by: (a) doing any act or thing which the person is prohibited from doing; or (b) failing to do any act or thing the person is required to do; (2) Any person who is convicted of an offence pursuant to this Bylaw is liable on summary conviction to a fine not exceeding $10,000.00 and in default of payment of any fine imposed, to a period of imprisonment not exceeding six months. (B/L 39M2002, 2002 December 16: Effective 2003 March 01) VIOLATION TICKETS AND SPECIFIED PENALTIES 8. (1) Where an officer believes that a person has contravened any provision of this Bylaw, the officer may commence proceedings against the person by issuing a violation ticket pursuant to the Provincial Offences Procedures Act. (2) The specified penalty payable in respect of a violation of a provision of this Bylaw shall be the amount shown as the specified penalty in Schedule “B” of this Bylaw in respect of that provision. (3) This section shall not prevent any Officer from issuing a violation ticket requiring a court appearance of the defendant, pursuant to the provisions of the Provincial Offences Procedure Act, or from laying an information in lieu of issuing a violation ticket. (4) Nothing in this Bylaw shall limit the authority of a designated officer to take steps to ensure compliance with this Bylaw. (B/L 39M2002, 2002 December 16: Effective 2003 March 01) MINIMUM PENALTIES AND SUBSEQUENT OFFENCES 8.1 The minimum penalty which may be imposed for: (a) a first offence in respect of a violation of any provision of this Bylaw shall be $50.00; (b) a second offence of the same provision of this Bylaw within a twenty-four month period shall be $100.00; BYLAW NUMBER 57M92 Page 13 of 21 (c) a third or subsequent offence of the same provision of this Bylaw within a twenty four month period shall be $200.00. (B/L 39M2002, 2002 December 16: Effective 2003 March 01) GENERAL APPLICATION 8.3 Nothing in this Bylaw relieves a person from complying with any federal or provincial law or regulation, other bylaw or any requirements of any lawful permit, order, or licence, and without restricting the generality of the preceding nothing in this Bylaw relieves a person from complying with the provisions of Safety Codes Act (R.S.A. 2000, chapter S-1), and the Occupational Health and Safety Act (R.S.A. 2000, Chapter O-2), and the regulations passed pursuant to those Acts.
